Accommodation Terms and Conditions
These Terms and Conditions apply to accommodation contracts and related agreements for “Tamagusuku Terrace” (hereinafter referred to as the “Property”), an accommodation facility operated by NAHAZO Co., Ltd. (hereinafter referred to as the “Company”).
Accommodation terms and conditions
- Article 1 — Scope
- Accommodation contracts and related agreements entered into between the Property and guests are governed by these Terms and Conditions.
- Matters not provided for in these Terms and Conditions are governed by applicable laws and regulations or generally established customs.
- If the Property agrees to a special arrangement to the extent that it does not conflict with applicable laws, regulations or customs, that special arrangement will take precedence over these Terms and Conditions.
- Article 2 — Application for an Accommodation Contract
- A person applying for an accommodation contract must provide the Property or the reservation system with the following information that the Property considers necessary.
- Name of guest
- Dates and length of stay
- Number of guests
- Contact information
- Information necessary for payment
- Other information considered necessary by the Property
- If the information provided at the time of application is incorrect, or if required information is not provided, the Property may be unable to accept the reservation, conclude the accommodation contract or provide accommodation services.
- A person applying for an accommodation contract must provide the Property or the reservation system with the following information that the Property considers necessary.
- Article 3 — Formation of the Accommodation Contract
- An accommodation contract is formed when the Property accepts the reservation and issues a reservation confirmation.
- When a reservation is made through a booking site or reservation system, the accommodation contract is formed when the reservation is confirmed through that booking site or reservation system.
- For reservations made through third-party booking sites, the terms of use, cancellation policies and other rules of the relevant booking site may apply in addition to these Terms and Conditions.
- Article 4 — Accommodation Charges and Payment
- The amount payable by the guest consists of the accommodation charge, cleaning fee and any other charges displayed on the booking page at the time of reservation.
- For standard reservations, 100% of the total reservation amount will be automatically charged to the registered credit card 7 days before check-in.
- For reservations made within 7 days of check-in, 100% of the total reservation amount will be charged after the reservation is confirmed.
- If a reservation is cancelled between 30 and 8 days before check-in, a cancellation fee equal to 50% of the total reservation amount will apply. The cancellation fee will be charged to the registered credit card 7 days before the originally scheduled stay.
- If payment cannot be completed successfully, the Property may suspend or cancel confirmation of the reservation, continuation of the accommodation contract or provision of accommodation services.
- Article 5 — Cancellations
- If a guest cancels an accommodation contract, the following cancellation fees will apply.
- Up to 31 days before check-in: No cancellation fee
- From 30 days through 8 days before check-in: 50% of the total reservation amount
- From 7 days before check-in through the date of arrival: 100% of the total reservation amount
- No-show without notice: 100% of the total reservation amount
- Cancellation fees are calculated based on the total reservation amount, including the accommodation charge and cleaning fee.
- Cancellation procedures, refunds, changes to stay dates and treatment of force majeure are governed by the separate Cancellation Policy established by the Property.
- If a guest cancels an accommodation contract, the following cancellation fees will apply.
- Article 6 — Refusal or Termination of an Accommodation Contract by the Property
The Property may refuse to enter into an accommodation contract or may terminate an accommodation contract in any of the following circumstances.
- When the application for accommodation does not comply with these Terms and Conditions.
- When no accommodation is available due to full occupancy or other circumstances.
- When the person seeking accommodation or a guest is reasonably considered likely to engage in conduct contrary to applicable laws and regulations, public order or good morals.
- When the person seeking accommodation or a guest has engaged in conduct that causes significant inconvenience to other guests, nearby residents or persons associated with the Property, or is reasonably considered likely to do so.
- When the person seeking accommodation or a guest repeatedly makes demands that impose an excessive burden, unreasonable requests for discounts, requests for services not included in the contract, prolonged unreasonable demands, abusive language, threats, intimidating conduct or other similar acts toward the Property or persons associated with the Property.
- When the person seeking accommodation or a guest is reasonably considered to be a member of an antisocial force or a person equivalent thereto.
- When a guest fails to comply with the Property’s rules of use, prohibited activities or instructions necessary for safety or hygiene.
- When a guest fails to cooperate with completion of the guest register, identity verification, payment or other procedures necessary for accommodation.
- When the number of persons staying at or entering the Property exceeds the number included in the reservation.
- When a guest smokes inside the villa, or engages within the Property or its grounds in the use of fire, excessive noise, an unauthorized party, bringing pets, damage to the Property or its equipment, conduct that disturbs nearby residents, or any other conduct prohibited by the Property.
- When the Property determines that it is difficult to accommodate guests safely due to a natural disaster, property failure, serious equipment malfunction or other unavoidable circumstances.
- When any other grounds for refusal of accommodation or termination of an accommodation contract under the Hotel Business Act or other applicable laws and regulations apply.
- Article 7 — Guest Register
- Guests must provide their name, address, contact information and other information required by the Property for the guest register in accordance with applicable laws and regulations.
- Foreign guests who do not have an address in Japan must provide their nationality, passport number and other information required under applicable laws and regulations.
- If required information is not provided, the Property may terminate the accommodation contract and refuse to provide accommodation services.
- Article 8 — Check-in and Check-out
- Check-in is from 4:00 PM, and check-out is by 10:00 AM.
- The Property will provide information regarding check-in procedures, entry to the villa, and use of keys, smart locks or similar access methods by the date of stay.
- If a guest leaves the Property after the designated check-out time, an additional charge may apply.
- Early check-in or late check-out is available only when approved by the Property in advance.
- Article 9 — Rules for Use of the Property
Guests must comply with the following rules when using the Property.
- Follow the rules of use, house guide and other instructions provided by the Property.
- Do not allow more people to stay at or enter the Property than the number included in the reservation.
- Do not smoke inside the villa.
- Do not use open flames, fireworks, candles, barbecue equipment or other hazardous items without authorization.
- Do not play loud music, make excessive noise late at night or early in the morning, or otherwise disturb nearby residents.
- Do not hold parties or events, conduct photography or filming, or carry out commercial activities without authorization.
- Do not bring pets.
- Use any sauna, jacuzzi, cold bath, pool, kitchen, electrical appliances or other equipment provided at the villa safely and appropriately.
- Do not use the sauna, jacuzzi, cold bath, pool or other facilities when under the influence of alcohol, feeling unwell or otherwise not in a condition to use them safely.
- When children use a cold bath, pool, jacuzzi or similar facility, a parent, guardian or accompanying adult must supervise their safety.
- Do not intentionally or negligently damage, soil or lose the Property, facilities, equipment, linens, consumables or other items.
- Do not engage in conduct that violates applicable laws and regulations, public order or good morals, these Terms and Conditions or any other rules established by the Property.
- Article 10 — Use of Parking
- The Property’s parking area may be used by guests during their stay.
- The Property is not liable for theft, loss, damage, accidents or other loss involving vehicles, items carried in vehicles, valuables or other property in the parking area, except where such loss is caused by the intentional misconduct or gross negligence of the Property.
- If a guest intentionally or negligently causes damage to the parking area, facilities, other vehicles, neighboring properties or other property, the guest must compensate for the resulting damage.
- Article 11 — Valuables and Personal Belongings
- Guests are responsible for managing their own cash, valuables, personal effects and other belongings.
- The Property is not liable for theft, loss or damage to a guest’s belongings except where caused by the intentional misconduct or gross negligence of the Property.
- Article 12 — Lost Property
- If an item left behind by a guest is found, the Property will retain it for a certain period.
- If a guest requests the return of a lost item, the guest is responsible for the cost of returning it.
- Food and beverages, hygiene products and other items unsuitable for storage may be disposed of at the discretion of the Property.
- Items whose owner cannot be identified, or items for which no contact is received after a certain period, may be disposed of in accordance with applicable laws and regulations or at the discretion of the Property.
- Article 13 — Housekeeping, Linen Changes and Services During a Stay
- The Property is a private whole-villa accommodation. Daily housekeeping, linen changes, towel changes, luggage storage and similar services during a stay are not included in the standard service.
- If special assistance is requested, please contact the Property in advance. Whether such assistance can be provided, any applicable charge and the time at which it may be provided are at the discretion of the Property.
- In an emergency, for equipment inspections, to prevent accidents, or when required by law or for safety reasons, persons associated with the Property may enter the villa after contacting the guest, or before contacting the guest where the situation is urgent.
- Article 14 — Guest Responsibility
- If a guest intentionally or negligently causes damage to the Property, facilities, equipment, linens, consumables, neighboring properties, third parties or other persons or property, the guest must compensate for that damage.
- The person who made the reservation is also responsible to the Property for the conduct of accompanying guests and visitors.
- If a guest’s violation of the rules of use results in additional cleaning, repairs, replacement, responses to nearby residents, suspension of operations or other loss, the Property may charge the guest for the actual costs incurred and a reasonable amount of resulting damages.
- Article 15 — Liability of the Property
- If the Property causes damage to a guest for reasons attributable to the Property in the performance of an accommodation contract or related agreement, the Property will compensate the guest for that damage.
- However, the Property is not liable for damage caused by natural disasters, transportation disruptions, communication failures, acts of third parties, the intentional misconduct or negligence of a guest, or other circumstances outside the Property’s control and not attributable to the Property.
- Article 16 — Force Majeure
- Performance of all or part of an accommodation contract may become difficult due to a typhoon, earthquake, tsunami, heavy rain or other natural disaster, major suspension or cancellation of transportation services, government-imposed travel restrictions, the spread of an infectious disease, power outages, communication failures, serious equipment malfunctions or other circumstances not attributable to the Property.
- In such circumstances, cancellation fees, refunds, changes to stay dates and other treatment will be handled in accordance with the separate Cancellation Policy established by the Property and the Property’s determination.
- Article 17 — Handling of Personal Information
The Property handles guests’ personal information in accordance with the Privacy Policy separately established by the Company.
- Article 18 — Changes to These Terms and Conditions
- The Property may amend these Terms and Conditions in response to changes in applicable laws and regulations, changes to services, changes in reservation-system specifications, operational requirements or other circumstances.
- Any amended Terms and Conditions will become effective when they are posted on this website.
- Article 19 — Governing Law and Jurisdiction
- These Terms and Conditions are governed by the laws of Japan.
- If a dispute arises in connection with an accommodation contract or these Terms and Conditions, a court in Japan having jurisdiction over the location of the Property or the location of the Company will be the agreed court of jurisdiction in the first instance. However, this does not exclude any other jurisdiction recognized under applicable laws and regulations.
